History of the Kahnawake Gaming Commission
1982 – Constitutional Foundation
The Canadian Constitution Act of 1982 formally recognises Kahnawake's territory and confirms its right to self-governance, including gambling regulation. This creates the legal foundation for everything that follows.
1996 – The KGC is Established
The Kahnawake Gaming Commission was established on 10 June 1996 under the Kahnawake Gaming Law (MCR No. 26 / 1996-97). At this stage, the commission's authority covers only the territory's land-based casinos and poker rooms, three poker facilities located within the Mohawk Territory.
The regulatory model was inspired by Australian gambling oversight practices, which the commission studied before building its own framework.
1999 – The Online Era Begins
On 8 July 1999 the KGC issued its Regulations Concerning Interactive Gaming, making it one of the first regulators anywhere in the world to formally regulate online casino operations. This was not a reactive measure, the commission actively built a framework for something most jurisdictions were still ignoring.
The same year saw the establishment of Mohawk Internet Technologies (MIT) a technical infrastructure company that provided physical server hosting for KGC-licensed online casinos. This is unique in the licensing world: Kahnawake became not just a regulator but a literal technical home for the casinos it licensed. Servers sat on the territory itself.
2009 – Significant Enforcement Action
The KGC conducted a major investigation that resulted in substantial enforcement action against several licence holders. This demonstrated the commission's willingness and capability to act against operators, not just collect fees.
2016 – US Market Exit
In 2016 the KGC reached an agreement to stop licensing sites accepting US players. This was a significant strategic decision that closed off the largest single gambling market in the world. It was done in cooperation with US authorities and reflects the commission's awareness of its international relationships for better or worse, it cost the licence considerable commercial relevance.
2025-2026 – Current Position
The KGC remains active. In April 2026 the commission issued a warning about a fraudulent website (kahnawake-gaming-licenses.com) impersonating official KGC communications. In the same month, EINRAI LTD. had its licence revoked by commission resolution, a reminder that enforcement is ongoing and not merely symbolic.
